Terms and Conditions
General Guarantees
In all circumstances, we comply with and fully respect Australian Consumer Law in relation to consumer rights.
The product we sell is a handmade timber potty, designed specifically for the purpose of holding soil and turf. We do not supply the soil or turf, which is purchased separately from a supplier of your choice. As such, our guarantees do not extend to the turf or soil, nor to the condition, lifespan, or results of turf usage, as these factors are influenced by user maintenance and other variables outside our control.
Custom products are tailored to specific requests and may differ in performance from standard products. However, they remain subject to all consumer guarantees under Australian law.
Product Use Disclaimer
Our products are designed solely for their intended purpose as a natural grass dog potty. We are not liable for any damage, injury, or failure resulting from unintended use, modification, or use in unsuitable environments. Natural timber may exhibit slight variations in grain, colour, and finish. These characteristics are normal and not considered faults.
Maintenance & Warranty
Longevity of the product depends on proper maintenance. As timber is a natural material, minor expansion, contraction, and weathering may occur over time. We offer a 12-month warranty covering manufacturing defects in the timber frame and structural integrity. This warranty excludes general wear and tear, misuse or neglect, and damage from prolonged exposure to unusual elements.
Refund Policy – Change of Mind
If your order has not yet been collected by courier or yourself, we will refund your order in full, minus any applicable bank transaction fees (3% for card transactions or 7% for AfterPay).
If your order has already been shipped or collected, returns will be accepted within 30 days of purchase, provided the item is unused, in resalable condition, and in original packaging. In this case, you are responsible for return courier costs. Your refund will be less the original shipping cost and transaction fees. A $20.00 restocking and handling fee will also apply.
Please note that engraved timber nameplates and any other customised products are non-refundable.
Damaged or Lost Goods
If your goods arrive damaged during transit, we will repair or replace the item at our cost, provided the damage is reasonable and not disproportionate to the loss. Please contact us promptly so we can assist.
If your order is lost in transit, we will either issue a full refund or send a replacement at no charge, provided we can verify the loss with the assistance of your co-operation in the investigation. This does not apply if the loss occurred due to an incorrect address provided by you or failure to collect the item from a collection point within the required timeframe.
Shipping & Delivery Terms
Changes to the delivery address, such as correcting errors or redirecting after dispatch, may attract courier fees. If the error was ours, we will cover the cost. If the error was yours, these costs will be passed on to you.
If delivery is refused or if the courier is unable to deliver and the item is not collected from the depot in time, the item will be returned to us. You will be responsible for any additional shipping costs incurred.
While courier delays are rare, they can happen. We are not liable for courier delays but will work with the courier to help resolve the issue. If your order is lost in transit, we take full responsibility and will send a replacement or issue a refund as per above.
Authority to Leave (ATL)
All orders are shipped with Authority to Leave by default. This means the courier will leave the item in a safe place if one is available. This helps avoid redelivery fees and the need for someone to be present at the time of delivery.
If you do not have a safe place for delivery, please notify us before dispatch. If no alternative instructions are provided and the courier cannot find a safe place to leave the order, you may be responsible for a redelivery fee, which is typically the same as the original shipping cost.
Limitation of Liability
To the extent permitted by law, our liability is limited to the repair or replacement of the goods, or a refund, at our discretion. We are not liable for indirect or incidental losses, consequential damage, or issues arising from factors outside our control, including the performance of turf or soil used with the product.
Force Majeure
We are not responsible for any delay or failure to perform resulting from causes beyond our control, including but not limited to natural disasters, courier strikes, accidents, pandemics, or government restrictions.
Dispute Resolution
We are committed to resolving any complaints quickly and fairly. If you have an issue, please contact us directly. If a resolution cannot be reached informally, both parties agree to seek mediation before taking legal action.
