Terms & Conditions
The terms that apply when you buy from us, in Australia and the United States.

These Terms and Conditions (“Terms”) apply to your use of the Real Grass Puppy Potty website and your purchase and use of products sold under the Real Grass Puppy Potty brand.
For customers purchasing in Australia, products are supplied by Camitch Enterprises Pty Ltd trading as Real Grass Puppy Potty (RGPP), ABN 30 113 757 272.
For customers purchasing in the United States, products are supplied by Camitch Incorporated trading as Real Grass Puppy Potty.
Camitch Enterprises Pty Ltd and Camitch Incorporated are collectively referred to in these Terms as “Real Grass Puppy Potty,” “RGPP,” “we,” “us,” or “our.” The entity supplying your order is determined by the country in which the order is supplied.
For the purposes of these Terms: turf refers to natural grass supplied for use with our products in Australia; sod refers to natural grass supplied for use with our products in the United States; and where a provision applies to both markets, we may refer to turf/sod.
By accessing our website, placing an order, or purchasing our products, you agree to these Terms.
1. Consumer rights
Australian customers. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot legally be excluded under the Australian Consumer Law (“ACL”) or other applicable Australian law. Our voluntary warranties, change-of-mind policies, and other policies operate in addition to your rights under the ACL. Where a product fails to comply with a consumer guarantee, your rights under the ACL apply regardless of any separate warranty period or change-of-mind return conditions stated in these Terms.
United States customers. Nothing in these Terms excludes or restricts any consumer right or remedy that cannot legally be excluded under applicable U.S. federal or state law. Consumer rights may vary depending on the state in which you reside.
2. Products and intended use
Real Grass Puppy Potty products are designed specifically for use as natural grass dog potty systems. Our Grassifier and related products are designed to hold separately purchased natural grass — referred to as turf in Australia and sod in the United States — together with the soil or growing medium ordinarily supplied with it. Unless expressly stated otherwise, we do not supply the turf or sod.
Australian customers purchase turf separately from a turf farm, nursery, garden centre, hardware store, or other supplier. U.S. customers purchase sod separately from a sod farm, nursery, garden center, home improvement store, or other supplier.
We cannot guarantee:
- turf or sod availability in your area
- turf or sod pricing
- turf or sod dimensions
- grass variety
- quality or condition
- lifespan
- suitability for your particular climate or environment
- the performance of turf or sod supplied by another business
- or how long the turf or sod will remain alive, healthy, or usable
The condition and lifespan of natural grass depend on many variables outside our control, including climate, temperature, sunlight, watering, drainage, dog usage, grass variety, soil composition, environmental conditions, and customer maintenance. Turf and sod pricing may vary based on location, supplier, season, availability, and grass variety.
3. Third-party turf and sod suppliers
Our Turf Supplier Guide in Australia and Sod Supplier Guide in the United States, together with any recommendations or references to farms, nurseries, garden centres, hardware or home improvement stores, or other suppliers, are provided for customer convenience. Unless expressly stated otherwise, these suppliers are independent third parties.
We do not control and cannot guarantee their inventory, prices, opening hours, turf or sod dimensions, grass varieties, product quality, customer service, pickup arrangements, delivery services, or suitability for your particular requirements. We recommend contacting a supplier before travelling to confirm current availability, price, size, and grass variety.
Inclusion of a supplier in our Turf Supplier Guide or Sod Supplier Guide does not create a partnership, agency, franchise, employment relationship, joint venture, or other legal relationship between that supplier and Real Grass Puppy Potty. Customers purchase turf or sod directly from third-party suppliers at their own discretion.
4. Product use
Our products should only be used for their intended purpose and in accordance with the instructions provided. Subject always to rights that cannot legally be excluded, we are not responsible for damage, injury, loss, or product failure caused by:
- misuse
- unintended use
- improper setup or installation
- unauthorised modification
- failure to follow care instructions
- failure to perform reasonable maintenance
- use in unsuitable environments
- excessive force or loading
- deliberate damage
- damage caused by pets
- inappropriate chemicals, fertilisers, soil, turf, sod, cleaning products, or other materials
- unreasonable exposure to weather or environmental conditions
- or circumstances outside our reasonable control
Products may exhibit slight variations in colour, grain, texture, finish, dimensions, or manufacturing appearance. Reasonable variations that do not materially affect product functionality are not considered manufacturing defects.
5. Pet use and training
Every dog is different. While natural grass encourages instinctive toileting behaviour, we cannot guarantee that any particular dog will use the product or become toilet trained within a particular period of time.
Results depend on factors including the dog’s age, previous toilet-training habits, environment, placement of the potty, consistency, owner behaviour, training methods, frequency of use, and individual dog behaviour. Training guidance provided by Real Grass Puppy Potty is general information only and is not veterinary or professional animal behavioural advice.
6. Maintenance and limited lifetime warranty
Unless otherwise stated for a particular product, Real Grass Puppy Potty provides a limited lifetime warranty against manufacturing defects and failures affecting the structural integrity of the product, for as long as the product is owned by the original purchaser.
This warranty covers the quality and construction of the product. It does not cover wear, deterioration, or damage arising from use over time. Specifically, it does not cover:
- ordinary wear and tear
- cosmetic deterioration that does not affect functionality
- damage caused by pets
- misuse, abuse, or neglect
- improper assembly or installation
- unauthorised modification
- failure to maintain the product appropriately
- damage caused by extreme or unsuitable environmental conditions
- damage caused by turf, sod, soil, chemicals, fertilisers, cleaning products, or other third-party materials
- or damage occurring after the product has been materially altered
Where a valid warranty claim is accepted, we may, as permitted by applicable law: repair the product; provide replacement parts; replace the product; or provide a refund.
Australian customers. This limited lifetime warranty is provided in addition to your rights under the Australian Consumer Law. Nothing in this warranty excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot legally be excluded under the ACL. Where the ACL gives you rights or remedies that exceed or differ from this voluntary warranty, those statutory rights continue to apply.
United States customers. This limited warranty gives you specific legal rights. You may also have other rights under applicable federal or state law, which vary from state to state. Nothing in these Terms is intended to exclude or restrict any right or remedy that cannot legally be excluded or restricted.
7. Change-of-mind returns – Australia
This policy applies where an Australian customer simply changes their mind and is not exercising a right arising from defective, faulty, damaged, incorrectly supplied, or otherwise non-compliant goods.
Before courier or customer collection. If your order has not yet been collected by the courier or by you, we will refund your order, less applicable bank or payment transaction fees — 3% for card transactions, or 7% for Afterpay transactions.
After collection or dispatch. Change-of-mind returns will be accepted within 30 days of purchase, provided the product has not been used, is in resalable condition, is returned in its original packaging, and has not been damaged, altered, or modified.
For an Australian change-of-mind return:
- you are responsible for the cost of the return courier
- the original shipping cost will be deducted from your refund
- applicable transaction fees will be deducted from your refund
- and a $20 AUD restocking and handling fee will apply
If we arrange the return courier on your behalf, that cost may also be deducted. Refunds are generally processed after the product has been returned and inspected.
Customised products. Engraved nameplates and any other products made, engraved, personalised, or customised specifically for you are non-refundable for change of mind.
Australian Consumer Law exception. The fees, timeframes, and conditions in this section apply only to voluntary change-of-mind returns. They do not limit your rights under Australian Consumer Law. Where you are legally entitled to a repair, replacement, refund, reimbursement of return costs, or another remedy because goods fail to meet a consumer guarantee, the change-of-mind fees and restrictions above will not be applied in a way that limits those rights.
8. Change-of-mind returns – United States
This policy applies where a U.S. customer simply changes their mind and is not exercising rights relating to defective, damaged, incorrectly supplied, or otherwise non-conforming goods.
Before shipment. If your order has not yet entered fulfillment, been collected by a carrier, or been shipped, you may request cancellation. Your refund may be reduced by any payment processing, financing, merchant, transaction, or other charge that is genuinely non-refundable to us, where permitted by applicable law.
After shipment. Change-of-mind returns are accepted within 30 days of purchase, provided the product has not been used, is in resalable condition, is returned in its original packaging, and has not been damaged, altered, or modified in a manner that prevents resale.
For a U.S. change-of-mind return:
- you are responsible for return shipping
- the original shipping charges are non-refundable
- non-refundable payment processing or transaction costs actually incurred by us may be deducted where permitted by law
- and a US$20 restocking and handling fee will apply
If we arrange return shipping on your behalf, that cost may also be deducted. Refunds are generally processed following receipt and inspection of the returned goods.
Customised products. Engraved, personalised, custom-made, and other products specifically customised at your request are not eligible for change-of-mind returns. Nothing in this section restricts rights relating to defective or non-conforming goods that cannot legally be excluded under applicable federal or state law.
9. Order cancellations
If you wish to cancel an order, please contact us as soon as possible at contact@realgrasspuppypotty.com. We will make reasonable efforts to stop fulfillment. Once an order has entered fulfillment, been collected by a courier or carrier, dispatched, or shipped, it may need to be handled as a change-of-mind return, and the applicable deductions and return costs above will then apply.
10. Damaged or defective goods
If your order arrives damaged or you believe a product is defective, please contact us promptly and provide reasonable evidence of the issue. We may request photographs of the product, the damage or defect, the packaging, and the shipping label.
Where transit damage or a manufacturing defect is verified, we will provide an appropriate remedy in accordance with applicable law — replacement parts, repair, product replacement, or a refund. We may require reasonable cooperation while investigating or lodging a claim with the shipping provider. For Australian customers, nothing in this section limits your rights under Australian Consumer Law.
11. Lost goods
If an order is confirmed as lost in transit, we will either issue an appropriate refund or send a replacement at no additional charge. We may require your reasonable cooperation while investigating the loss with the shipping provider.
This does not apply where the loss or failed delivery occurs because you supplied an incorrect or incomplete address, requested an incorrect or unauthorised redirection, failed to collect the item from a depot or collection point within the required timeframe, or the loss resulted from another act or omission attributable to you — except where applicable law provides otherwise.
Claims of lost or damaged goods may be investigated. Where we reasonably believe a claim is deliberately false or fraudulent, we may provide relevant information to the shipping provider, payment provider, insurer, fraud prevention provider, or appropriate law enforcement authority.
12. Delivery addresses and redirection
Customers are responsible for checking that the delivery address and delivery information supplied at checkout are complete and accurate. Changes after dispatch — correcting an address, redirecting a parcel, changing a delivery location, or re-routing a shipment — may attract additional courier or carrier charges.
If the error was caused by us, we will cover the reasonable cost of correcting it. If the error was caused by information supplied by you, or you request a change after dispatch, the resulting courier, redirection, shipping, and handling fees may be passed on to you.
13. Failed delivery and return to sender
If delivery is refused, the shipping provider cannot complete delivery or access the location, you fail to collect an order, an incorrect or incomplete address was supplied, or the shipment is otherwise returned because of circumstances attributable to you, you will be responsible for reasonable additional costs incurred — return-to-sender shipping, courier or carrier fees, redelivery charges, new outbound shipping charges, and reasonable handling charges.
If you want the goods sent again, you may be required to pay the applicable redelivery cost before redispatch. If you instead request a change-of-mind refund once the product has been returned to us, the deductions applicable to your market under sections 7 or 8 may also apply.
14. Authority to leave – Australia
Unless otherwise stated, Australian orders are shipped with Authority to Leave (“ATL”) by default. The courier may leave the item in a location it considers reasonably safe if one is available. This helps avoid missed deliveries, depot collection, redelivery charges, and the need for somebody to be present at the time of delivery.
If you do not have a suitable safe place for delivery, please contact us before dispatch. If no alternative instructions are provided and the courier cannot find a safe place to leave the order, you may be responsible for a redelivery fee, which may be similar to the original shipping cost.
15. Delivery without signature – United States
Unless otherwise stated, U.S. orders may be shipped using a carrier service that does not require a signature. Where permitted by the carrier, the package may be left at a location the carrier considers suitable at the delivery address.
If you require a different delivery arrangement, please contact us before dispatch; alternative services may attract additional charges. If a shipment cannot be delivered and is returned because it was not collected or due to circumstances attributable to you, applicable return-to-sender and redelivery fees may apply. U.S. redelivery charges may be equivalent to or greater than the original shipping charge depending on destination, package dimensions, carrier, shipping zone, and applicable carrier surcharges.
16. Delivery times
Shipping and delivery timeframes displayed on our website are estimates unless expressly stated otherwise. Courier and carrier delays can occasionally occur. Subject to applicable consumer law, we are not responsible for delays caused solely by independent shipping providers or circumstances outside our reasonable control, but we will reasonably assist in investigating delayed shipments. If an order is ultimately confirmed as lost, we will provide a remedy in accordance with these Terms and applicable law.
17. Currency
Unless otherwise stated, orders supplied to Australia are displayed and charged in Australian dollars (AUD), and orders supplied to the United States are displayed and charged in U.S. dollars (USD). The website may allow customers to select or display different currencies. The currency confirmed at checkout applies to the transaction.
18. Taxes
For Australian orders, prices include or display GST where required by applicable Australian law. For U.S. orders, applicable state and local sales taxes may be calculated and added at checkout based on the delivery destination and our applicable tax obligations.
19. Pricing errors
We reserve the right to correct genuine pricing, typographical, promotional, technical, or website configuration errors. If an obvious pricing error materially affects an order, we may contact you before fulfillment and offer you the choice to proceed at the correct price, or cancel the affected order and receive a refund. Nothing in this section limits rights that cannot legally be excluded.
20. Promotions and discount codes
Promotional offers may be subject to conditions including expiration dates, minimum order values, geographic restrictions, product exclusions, usage limits, and customer eligibility requirements. Unless expressly stated otherwise, promotional offers cannot be combined. Discount codes must generally be entered at checkout and cannot be applied retrospectively after an order has been completed.
We may refuse or cancel promotional benefits obtained through fraud, deliberate manipulation, abuse, unauthorised duplication, or obvious technical error.
21. Product availability
Products may occasionally become unavailable or sell out. We reserve the right to limit quantities, discontinue products, modify products, update packaging, or cancel orders that we cannot reasonably fulfill. If we cannot supply a product you have paid for, we will provide an appropriate refund or alternative remedy in accordance with applicable law.
22. Product images and dimensions
We make reasonable efforts to represent our products accurately. However, colours, finishes, textures, dimensions, appearance, and packaging may vary slightly as a result of photography, screens, production processes, product improvements, or reasonable manufacturing tolerances. Minor variations that do not materially affect functionality are not considered manufacturing defects.
23. Turf and sod cutting and tools
Natural turf in Australia and sod in the United States may need to be cut or trimmed to fit your Real Grass Puppy Potty product. Customers are responsible for taking reasonable care when cutting and handling turf or sod. Any Turf Knife, utility knife, blade, cutting tool, or similar product should only be used safely and in accordance with its instructions. Subject to rights that cannot legally be excluded, we are not responsible for injuries caused by improper or unsafe use of knives, blades, or cutting tools.
24. Custom products
Products made or altered specifically at a customer’s request may differ from standard products. Customisation may affect appearance, dimensions, functionality, performance, or suitability. Customised products remain subject to mandatory consumer rights that apply in the customer’s jurisdiction.
25. Reviews and user-generated content
If you voluntarily provide us with a review, testimonial, photograph, video, social media post, written comment, or other content for publication or marketing purposes, you confirm that you own the content or otherwise have permission to provide it. You must not submit content that unlawfully infringes another person’s intellectual property, privacy, or other rights.
Where content is submitted to us for publication or promotional use, you grant Real Grass Puppy Potty a non-exclusive, worldwide, royalty-free licence to reproduce, publish, display, adapt, and use that content for legitimate business and marketing purposes, unless otherwise agreed.
26. Intellectual property
The Real Grass Puppy Potty name, Grassifier name, trademarks, logos, designs, product designs, packaging, photographs, videos, graphics, written content, website content, marketing material, and other intellectual property are owned by or licensed to Real Grass Puppy Potty, Camitch Enterprises Pty Ltd, Camitch Incorporated, or their related entities.
You must not, without our permission, copy, reproduce, commercially exploit, distribute, modify, imitate, republish, reverse engineer, or otherwise misuse our intellectual property except where permitted by applicable law.
27. Prohibited website use
You must not use our website for unlawful or fraudulent purposes; to interfere with website security or functionality; to introduce malicious software or code; to scrape or harvest information without authorisation; to impersonate another person; to conduct fraudulent transactions; or to infringe another person’s rights. We may cancel orders or restrict website access where we reasonably suspect fraud, abuse, or unlawful activity.
28. Fraud prevention
We may use payment verification, fraud-prevention, and risk-screening services. Where an order is identified as potentially fraudulent or high risk, we may request additional verification, temporarily delay fulfillment, refuse the transaction, or cancel and refund the order. We are not required to fulfill an order where we reasonably believe doing so would expose us or another person to fraud, unlawful activity, or unacceptable payment risk.
29. Limitation of liability
Nothing in this section excludes liability or consumer rights that cannot legally be excluded. To the maximum extent permitted by applicable law, Real Grass Puppy Potty and its related entities are not liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from circumstances outside our reasonable control. This includes losses arising solely from turf or sod quality, turf or sod lifespan, soil condition, third-party turf or sod suppliers, improper product use, improper maintenance, or other matters for which we are not legally responsible.
Australian customers. Any limitation in these Terms is subject to the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies an ACL consumer guarantee, remedy, or liability that cannot legally be excluded.
U.S. customers. To the maximum extent permitted by applicable law, our aggregate liability arising from or relating to a product purchase will not exceed the amount paid for the product giving rise to the claim. Some U.S. states do not permit certain exclusions or limitations of liability, so some of these limitations may not apply to you.
30. U.S. warranty rights
This section applies only to U.S. customers. Our limited lifetime warranty is subject to the terms set out in section 6. Nothing in these Terms is intended to disclaim or exclude implied warranties where doing so is prohibited by applicable federal or state law. To the extent permitted by applicable law, any implied warranties that may apply are limited in duration to the duration permitted under applicable law. Some states do not permit limitations on implied warranties, so certain limitations may not apply to you. You may have additional rights under the laws of your state.
31. Force majeure
Subject to applicable consumer law, we are not responsible for delays or failures caused by circumstances outside our reasonable control, including natural disasters, severe weather, fire, flood, transport disruption, courier or carrier strikes, port disruption, industrial action, pandemics or epidemics, war, civil unrest, government restrictions, supply-chain disruption, utility failure, or similar events. This provision does not limit mandatory consumer rights.
32. Third-party services and links
Our website may contain links to or integrations with third-party websites, payment providers, financing providers, shipping providers, social media platforms, turf or sod suppliers, or other services. Those third parties operate independently from us. Subject to applicable law, we are not responsible for their websites, services, policies, content, availability, pricing, or conduct.
33. Dispute resolution
We are committed to resolving complaints quickly and fairly. If you have an issue, please contact us first at contact@realgrasspuppypotty.com so that we have an opportunity to resolve the matter directly. Where appropriate and where a matter cannot be resolved informally, the parties may attempt good-faith mediation before commencing formal court proceedings. Nothing in this section prevents a consumer from exercising a legal right or accessing a regulator, tribunal, small claims process, court, or other remedy that cannot legally be restricted.
34. Governing law – Australian orders
For orders supplied to customers in Australia, these Terms are governed by applicable Australian law, including the Australian Consumer Law, and the laws of the Australian state or territory applicable to the transaction. Nothing in these Terms is intended to restrict any mandatory consumer protection available under Australian law.
35. Governing law – United States orders
For orders supplied to customers in the United States, these Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except to the extent mandatory federal law or consumer protection laws of the customer’s state of residence apply. Nothing in these Terms is intended to deprive a consumer of a right or remedy under applicable federal or state law that cannot legally be waived.
36. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary so that it is enforceable where possible. The remaining provisions will continue in effect.
37. No waiver
If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.
38. Entire agreement
These Terms, together with any policies, warranty terms, product-specific conditions, or other terms expressly incorporated into them, constitute the agreement between you and us relating to your use of our website and purchase of our products. Nothing in this section excludes representations, guarantees, or rights that cannot legally be excluded.
39. Changes to these Terms
We may update these Terms periodically to reflect changes to our products, services, website, business practices, or legal obligations. The version published on our website at the time of your purchase will generally apply to that purchase unless applicable law requires otherwise. The “Last updated” date at the top of this page indicates when these Terms were most recently revised.
